Terms and Conditions – Draft

Working draft for legal and operational approval

1. Scope and incorporation

This working draft is intended for driver-training contracts with Fahrschule Devam GmbH. Standard terms become part of a contract only if they are expressly brought to the learner’s attention when the contract is concluded, can reasonably be reviewed and the learner agrees to them. Individually negotiated terms take precedence.

Driver training is based on a written training contract. This draft does not replace that contract.

2. Subject of the training

The training comprises the agreed theory and practical instruction under the applicable statutory rules. The driving school owes proper training, but does not guarantee passing an examination or the grant of a driving licence.

3. Charges and scope of services

The type and amount of all charges are determined solely by the training contract actually concluded and the price notice published under section 32 of the German Driving Instructors Act (FahrlG). The information must satisfy the principles of price clarity and truthfulness.

This draft intentionally states no prices, payment periods or due dates. These points must be checked against the training contract actually used and expressly approved.

4. Cooperation and examinations

The learner provides the information and documents required for training and examination registration in good time, participates in instruction and informs the driving school of circumstances that may affect training or an examination. Presentation for an examination requires the statutory conditions and the training level required in the individual case.

5. Appointments and cancellations

Appointment changes and cancellations are governed by the separate, currently active cancellation terms shown during appointment confirmation, provided they were validly incorporated and accepted. This draft does not change the existing 48-hour rule, versioning or acceptance records.

This draft does not set a fee or lump-sum compensation for late cancellation or non-attendance. Any such provision requires review of the actual training contract and separate approval.

6. Contract term and termination

The contract term, ordinary termination, the required form of termination and possible payment consequences are not specified in this working draft. Until a reviewed provision is approved, the training contract actually concluded and statutory law apply. The right to terminate for good cause remains unaffected.

7. Liability

Statutory liability rules apply. This draft contains no additional limitation of liability. In particular, liability for intent, gross negligence, or injury to life, limb or health is not excluded.

8. Data protection

Information about the processing of personal data is provided in the privacy policy.

9. Statutory consequences of invalid provisions

If a provision, after later approval, is not validly incorporated or is invalid, the consequences are governed by statutory law, in particular section 306 BGB. An invalid provision is not replaced by a term less favourable to the learner.

10. Basis and approval status

This working draft was written independently with regard to the non-binding recommendation of the Bundesvereinigung der Fahrlehrerverbände dated 18 March 2026, section 32 FahrlG and sections 305–307 BGB. Before use as binding terms, the actual training contract, price notice and operational processes must be compared and legally reviewed.
